“FROM THREE DAYS TO THREE WORDS” (Updated and Re-Posted)

(Steven Hayward) Former Speaker Nancy Pelosi’s haughty dismissal in 2009 of the question of the constitutionality of Obamacare is getting widely recycled, and this week she was reduced to incoherence, as this RealClearPolitics video shows.  Excerpt: “I’m a supporter of judicial review, I honor the Constitution in that regard,” Pelosi said to reporters. “That’s why we wrote our bill in a way that was Constitutional. I still feel pretty confident about it. And if and when — this game is not over. In March Madness, what happens when your team doesn’t win one — well wait a minute, let’s have the game.” What??  Do Democrats really want to be led in the House by an obvious blithering idiot? Whatever.  This seems like a good opportunity, though, for me to repost an installment from my “ Progressive Versus Progressive ” series from a year ago, as Pelosi reminds us of how today’s “Progressives” are not merely incoherent, but intellectually lazy, too: A lot of the people who today call themselves “Progressives” express disdain for considering constitutional limits on government power, and in so doing offer up another example of how they do not live up to the example of their forebears from the Progressive Era. Although the Progressives of old did a lot of violence to the Constitution and set the stage for our era of the “living Constitution” (which means that the philosophy that gave birth to it is dead), most of those old Progressives at least understood that they needed to argue the matter, and some of them even respected that some constitutional limits still existed. I am struck by the fact that Senator Albert Beveridge (a Republican from Indiana), one of the leading Progressives and a wingman for TR, spent three days on the Senate floor in 1907 arguing extensively about the constitutionality of proposed child labor laws. He saw that a serious constitutional argument was necessary, and he made a strong case.
 This contrasts rather sharply with the answer given by the last Speaker of the House when asked by an impertinent reporter about the constitutional justification for Obamacare. Whereas Beveridge held forth for three days, Speaker Nancy Pelosi held forth for all of three words: “Are you serious?” “From three days to three words” might well be taken as the constitutional regress of what is called “progressivism” today.

Oh Brother. Air Claire McCaskill attacked out of state donors in her latest ad running in Missouri. But, of course, it’s OK for Claire to accept out of state donations. In fact a majority of her donations come from non-Missouri residents. The News Leader reported: U.S. Sen. Claire McCaskill, who has been bombarded by ads from out-of-state interest groups, is relying heavily on money from donors outside of Missouri to help finance her re-election campaign. Non-Missouri residents contributed about 60 percent of the $3.7 million McCaskill raised from individuals who gave at least $200 to her campaign since 2007, according to an analysis of campaign finance data by the St. Louis Post-Dispatch (http://bit.ly/GQaISf ). That’s a bigger percentage of out-of-state money than most of the other 22 U.S. senators facing re-election this year. Together, 48 percent of their donations of $200 of more came from outside their home states. The analysis, reported Monday by the newspaper, used donations as of Dec. 31 and excluded donations of less than $200, which are not included in the Federal Election Commission’s database. McCaskill, a Democrat, already has been targeted with advertisements by national groups such as Crossroads GPS and the U.S. Chamber of Commerce. Crossroads GPS, a Washington-based group founded by political strategist Karl Rove that spends money to help elect Republicans, has labeled McCaskill as one of its top targets for the 2012 election. It spent more than $1.5 million on advertisements against McCaskill last year, said Nate Hodson, a spokesman for the group.

(Reuters) – Democratic Representative Jay Inslee said on Saturday he would step down from Congress later this month to focus on his campaign for governor of Washington state. Inslee, who has served since 1999, said his resignation would take effect on March 20. He is vying with Republican Rob McKenna, the state attorney general, to replace Democratic Governor Christine Gregoire. A recent poll had the two rivals tied. “I am excited about focusing full-time on talking about my job-creation agenda and building a new economy for Washington state,” Inslee said in a statement. …

Rush Limbaugh weighed in on Barack Obama’s call of support today to the 3 0 year-old “coed” and socialist activist Sandra Fluke. Via The Blaze : Here’s the transcript : Apparently Sandra Fluke told Obama something. When he asked her if she’s okay, she said that Obama told her that she should tell her parents they should be proud. (pause) Okay, I’m button my lip on that one. The president tells Sandra Fluke (chuckling), 30-year-old Sandra Fluke, that her parents should be proud. Okay. Let me ask you a question. I might be surprised at the answer I would get to this question. Your daughter appears before a congressional committee and says she’s having so much sex, she can’t pay for it and wants a new welfare program to pay for it. Would you be proud? I don’t know about you, but I’d be embarrassed. I’d disconnect the phone. I’d go into hiding and hope the media didn’t find me. See, everybody forgets what starts this, or what started this whole thing. Or maybe they don’t! Maybe that’s normal behavior on the left now, for all I know. But it’s one thing for Obama to call and ask her if she’s okay. I’m waiting for Bill Clinton to call her.

Why Can’t the Obama Administration Make Its Case Without Disseminating Hate?

(John Hinderaker) Have we ever had an administration like Barack Obama’s? An administration that tries to benefit from pitting Americans against one another? An administration that uses its billion-dollar slush fund, not to mention the resources of the Executive Branch, to demonize private citizens who disagree with its policies? An administration that uses hate as an instrument of domestic politics? I don’t believe that there is any precedent in American history for the mean-spiritedness that now emanates from 1600 Pennsylvania Avenue. We wrote here about Obama’s effort to raise money by falsely demonizing Charles and David Koch, two principled private citizens who disagree with his policy positions, and here about the Koch Companies’ response to Obama’s misrepresentations. Now the Obama campaign has fired back , evidently believing there is more political profit to be gained by demonizing private citizens: The president’s campaign manager, Jim Messina, sent a letter to Philip Ellender, Koch’s president for government and public affairs, disputing Ellender’s claim that an organization partially backed by the brothers [Americans For Prosperity] represented the interests of thousands of grassroots donors. It is an indisputable fact that nearly two million Americans have participated in Americans For Prosperity’s activities, and around 50,000 Americans have contributed to the organization. “You argue that Americans for Prosperity is a grassroots organization of everyday citizens. But its emphasis on rolling back environmental protections and blocking a clean energy economy appears to be nothing more than an effort to promote the corporate interests of your employers and others who lavishly, and secretly, fund its operations,” Messina wrote. It is no secret that many millions of Americans–including us!–want to develop America’s energy resources. This is one of the fundamental political issues of our time. The idea that creating American jobs and American wealth by allowing American energy resources to be developed is “nothing more than an effort to promote the corporate interests of your employers and others” is, frankly, idiotic. It would be accurate, on the other hand, to say that the Obama administration’s funneling of many billions of dollars to inefficient “green” energy scams is “nothing more than an effort to promote the corporate interests of” Obama’s political backers. “You note in your letter that Americans for Prosperity has tens of thousands of members and contributors from all walks of life across the country, suggesting that this is the source of AFP’s funding. There is one way to verify your point: disclose those donors for the public to make that judgment,” Messina writes. This is profoundly stupid. Neither Koch Industries nor any other Koch entity controls Americans For Prosperity. Koch has no ability to “disclose” the identities of the tens of thousands of Americans who have contributed to AFP, or to order AFP to do so. Under federal law, AFP is not obliged to disclose its donors. But, hey: disclosure is a two-way street. How about if Barack Obama persuades the many liberal organizations who support his policies–MoveOn.org, the Center for American Progress, the Democracy Alliance and many others–to disclose their donors? Hmm? Don’t worry, that isn’t going to happen. The Democrats would be embarrassed to admit that their funding comes from 1) rich liberals, and 2) union dues that are coerced involuntarily from union members, with hardly any coming from ordinary Americans who freely give their own money. For Koch’s characteristically temperate and reasoned response to the Obama administration’s latest demagogic attack, go here . An excerpt: Your letter never addresses the fundamental issue I raised concerning the impropriety of a sitting President and his campaign publicly attacking two private citizens for exercising their free speech rights. While we encourage and welcome a principled and civil debate about the important issues our great nation faces, it is inappropriate and beneath the office of the President to denounce an American company like ours that employs 50,000 people here in the United States, malign its owners with repeated misstatements and distortions, and harass our effort to speak out just because you disagree with our consistent support for the principles of a free society. Your demand, for instance, that Koch disclose the names of Americans for Prosperity donors is misguided given that AFP is a separate and independent organization. Your demand is also hypocritical, particularly given the President’s own reliance on anonymous donors now and in the past. Koch complies with all laws regarding disclosure of political contributions. However, given the hostile rhetoric that you, the Democratic party, and your allies have aimed at us and others who disagree with your point of view, it is easy to understand why people have valid reasons to retain their privacy. To cite just one example, Koch and its owners have been the target of many threats of violence over the past two years by some who disagree with our view on public policy issues. In light of that, I think most Americans would agree it is at odds with our national values for the President and his aides to single out and personally impugn private citizens for political gain. The Obama administration continues to embarrass itself through its uniquely repugnant combination of ignorance and mean-spiritedness.

This is pure insanity: Below is a recording of the court transcript. The judge dismissing the case after lecturing the victim for insulting the Islamic prophet Muhammad starts at 28:30, in case you don’t have time to listen to the entire 36 minutes. Update: (Thanks, wtd) Perce, the victim in this case, is being threatened with jail time for posting the audio of his trial. This is pure sharia in America, where the victim is punished and the perpetrators are freed, and where the judge ignore human rights in favor of Islamic superiority.
